Welcome to our website (the “Site”) operated by the Virtual Reality Innovation Hub. By accessing or using the Site, you accept and agree to be bound by these Terms & Conditions (the “Terms”). If you do not agree with them, please do not use the Site.

We may modify these Terms from time to time. The date of the last update will appear at the top of this page. Your continued use of the Site after such changes constitutes acceptance of the updated Terms.

1. Use of the Site

1.1 Eligibility – You represent and warrant that you are at least 18 years old (or the legal age in your jurisdiction) and capable of entering into binding contracts.
1.2 Permitted Use – You may use the Site for the purposes of obtaining information about our services, applying for programmes, and other authorised uses.
1.3 Prohibited Conduct – You agree not to:

• Use the Site for unlawful or unauthorised purposes.
• Violate any applicable laws or regulations.
• Access or attempt to access restricted portions of the Site.
• Interfere with the Site’s operation or security.
• Upload or transmit viruses, malicious code or harmful data.
• Use automated means (bots, scrapers, etc) to access the Site without our permission.

2. Content and Intellectual Property

2.1 Ownership – All content on the Site, including text, images, graphics, logos, downloadable materials, software and other elements (“Content”), is owned or licensed by us, and is protected by copyright, trademark and other intellectual property laws.
2.2 Limited Licence – We grant you a limited, non-exclusive, non-transferable licence to access and view the Content for your personal, non-commercial use.
2.3 Restrictions – You may not reproduce, modify, transmit, distribute, display, publish, licence, create derivative works from or otherwise exploit the Content without our prior written consent.
2.4 User-Generated Content – If you submit or post content to the Site (for example via application forms or contact forms), you grant us a worldwide, royalty-free, sublicensable, transferable licence to use, reproduce, modify, adapt, publish, translate, distribute and display that content for our purposes.

3. Courses, Programmes & Services

3.1 Descriptions – We endeavour to describe our courses, programmes and services accurately on the Site. However, we do not warrant that all descriptions and other content are complete, accurate, reliable, current or error-free.
3.2 Applications & Acceptance – By applying to a course or programme you agree to comply with any additional terms we may impose. Acceptance into a programme is at our sole discretion.
3.3 Fees & Payments – Where applicable, you agree to pay any fees associated with a programme before it begins or as otherwise agreed.
3.4 Refunds & Cancellation – Any refunds or cancellations will be subject to our separate policies (which will be published or provided to you upon application). We reserve the right to cancel or reschedule programmes; in such event our liability is limited to refunding fees paid.

4. Disclaimers & Limitation of Liability

4.1 No Warranty – The Site and all Content are provided “as is” and “as available” without any warranty (express or implied), including but not limited to implied warranties of accuracy, completeness, merchantability or fitness for a particular purpose.
4.2 No Guarantee of Results – Participation in our courses or programmes does not guarantee you any specific academic, professional or financial result.
4.3 Limitation of Liability – To the maximum extent permitted by applicable law, we (and our officers, directors, employees and agents) will not be liable for any indirect, incidental, special, punitive or consequential damages, or any loss of data, revenue or profits arising out of or in connection with your use of the Site or our services.
4.4 Maximum Aggregate Liability – In jurisdictions that allow limitation of liability, our aggregate liability for any claim arising from or in connection with these Terms or the Site shall be limited to the amount you paid us (if any) in the 12 months preceding the claim.

5. Links to Third-Party Sites

The Site may contain links to third-party websites or resources. We do not control those websites and are not responsible for their content, availability or practices. Inclusion of any link does not imply endorsement. You access linked sites at your own risk.

6. Privacy & Data Protection

Your use of the Site is also subject to our Privacy Policy, which is incorporated herein by reference. Please review the Privacy Policy to understand how we collect, use, process and protect your personal data.

7. Indemnification

You agree to indemnify, defend and hold harmless the Organisation, its officers, directors, employees, agents and affiliates from and against any and all claims, liabilities, losses, damages, costs or expenses (including reasonable legal fees) arising out of or relating to your use or misuse of the Site, violation of these Terms, or violation of any rights of a third party.

8. Termination

We may suspend or terminate your access to the Site, or refuse to provide access to our programmes, at any time, with or without cause or notice. Upon termination, all licences granted by us shall immediately cease and you must stop using the Site.

9. Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the Republic of South Africa. Any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Johannesburg, Gauteng, South Africa.

10. Severability

If any provision of these Terms is held to be invalid, illegal or unenforceable by a court of competent jurisdiction, that provision shall be severed and the remaining provisions shall continue in full force and effect.

11. Entire Agreement

These Terms (together with our Privacy Policy and any other documents expressly referenced herein) constitute the entire agreement between you and the Organisation concerning your use of the Site and our services, and supersede all prior or contemporaneous communications, representations, proposals or agreements, whether electronic, oral or written.
